What if my spouse doesn’t want a divorce?

When the spouses are in disagreement regarding whether or not to proceed with the divorce, mediation is not an option for your case. However, you are still able to get a divorce. The process is often a little more tense and expensive; however, both spouses do not need to be in agreement in order for the divorce to be finalized. Our lawyers can provide you advice during this time.

How do I best protect my children through this divorce?

Being honest with your children is important; however, it is also in their best interests if you do not discuss the relative cooperation of your spouse with them. Your children need to know that both parents love them, even if the relationship between the parents is coming to an end. Giving them the opportunity to discuss child custody arrangements and work with your attorney to keep the children out of court.

I want to get married again. How does this affect our divorce settlement?

In many cases, the settlement may not be affected by a remarriage. However, spousal support payments or child custody arrangements may need to be revisited, provided that the remarriage involves a move, an increase in salary, or other factors that can potentially alter a child’s standard of living.

We want to proceed with an uncontested divorce. Can you represent both of us?

Due to the potential for conflict of interest, one attorney is not able to represent both spouses, even if both spouses are proceeding amiably. Each spouse will need to retain the services of their own lawyers, in order to best protect themselves and their financial assets.

What use is a prenuptial agreement if we never get divorced?

In a perfect world, a prenuptial agreement would be obsolete! Drafting a pre-nup agreement does not imply that you are foreseeing the failure of your marriage. Instead, the agreement is an excellent opportunity for the two of you to address your financial status, and to have open discussions about some of marriage’s tougher questions. Use this as an opportunity to look out for both of your best interests in the event of something unforeseeable.
