Alimony in Massachusetts

Let Our Framingham Divorce Lawyer Help You Start a New Life

Alimony, also known as spousal support or maintenance, is a type of payment one spouse provides the other after a divorce. It is designed to help a lower-earning spouse--or a spouse who has been out of the workforce due to taking care of the household or raising children--to get through the divorce process and transition into a self-supporting new life.

Common types of alimony in a Massachusetts divorce include:

  • General alimony
  • Rehabilitative alimony
  • Reimbursement alimony
  • Transitional alimony

At Barach Law Group LLC, we can help you determine the amount of alimony you deserve to help you start a brand-new chapter in life. With more than 20 years of experience, our Framingham divorce attorney can help you navigate the intricacies of the divorce process and obtain the most favorable settlement possible.

How Long Does Alimony Last?

When it comes to general term alimony, the amount of time the alimony obligation will last depends on the length of the marriage. For instance, alimony for a marriage that lasted less than five years will only last for a maximum 50 percent of the length of the marriage; 60 percent if 10 years or less, but more than five years; 70 percent if 15 years or less, but more than 10 years; and 80 percent if 20 years or less, but more than 15 years.

However, in a marriage which lasts 20 years or more, the court has the discretion to order spousal support for an “indefinite length of time,” although it is not required. Deviation beyond the time limits can occur if necessary “in the interests of justice.”
